Fathers’ Rights And Paternity Actions

Once paternity is confirmed, a father has a legal right to establish a relationship with his son or daughter. In general, after paternity is determined, a father has the following rights:

  • A right to visitation with his child
  • A right to challenge the adoption of his child
  • A right to pursue the custody of his children in certain circumstances


Paternity, Child Support And Other Benefits

A boyfriend or ex-spouse who denies fathering your child can be required by the court to pay child support after it has been determined that your children were fathered by him. Depending on the age of the children involved, a father may be required to pay past due child support as well. Determining the paternity of your children may provide them with the following benefits:

  • Legal entitlement to receive child support
  • Legal obligation of the father to pay child support
  • Inheritance rights
  • Right to participate in the probating of a deceased father’s estate
  • Right to receive a deceased father’s Social Security or veteran’s benefits

How A DNA Paternity Test Works

Our attorneys prepare and file all necessary paperwork requesting the court to order a paternity test. Afterward, the father — and any children — will be required to submit to a DNA test. These tests are commonly performed by a technician in a certified medical facility. The technician will use a sterile cotton swab to collect DNA from the inside of the cheek of the test subject. The samples will then be sent to a lab for analysis. After the lab analyzes the samples, the results will be mailed to the court to be entered into the record. Once paternity has been established, legal motions for parental rights or child support can then proceed.
