Leominster Modify Child Custody Attorney
At the Roncone Law Offices, P.C., our family law attorneys have more than 65 years of combined experience helping to modify Divorce and Probate Court Judgments for our clients in Leominster, Fitchburg, Worcester and the surrounding parts of Massachusetts. Are you planning on moving to another city or state? Did your child request to live with a different parent? Did you or your former partner lose a job? Do you want to contest a change in visitation schedules? We can help.
In most cases, any Divorce Judgment regarding issues of minor children (child support, child custody and visitation, tax exemptions, health coverage) can usually be modified upon showing of a substantial and material change in circumstances. This includes:
- Loss of job or benefits
- Parental relocation
- Illness or injury
- Remarriage
- Substantial change in income
- Allegations of abuse or DCF investigations (social services)
- Change in school schedules or extracurricular activities
- Changes to the law
Some divorce agreements cannot be modified, however, depending on the terms of the Divorce Judgment. It is important to discuss your specific case with a family law attorney to learn about your legal options.
Don't Modify an Order on Your Own
Consult with an experienced family law attorney before you attempt to alter the terms of a Probate Court Order or Judgment directly with another party. This is a formal process. A simple agreement with your former partner may seem like a good idea. However, you may be held in contempt of court later on if you do not follow the requisite procedures and properly modify or change the prior Judgment with the Probate and Family Court. If both parties agree to the modification, and if there are few or no concerns about the children, the process should be fairly quick and easy. Additionally, an attorney can ensure that all issues are addressed with the modification — whether the issue is an adjustment to child support, revised visitation schedule, changes in payments for extra activities and more.
